Parliament concludes its second session without approaching anti-corruption legislation

an introduction            

Partners for Transparency continues to issue its reports related to monitoring and analyzing incidents of corruption that are revealed by the various authorities, with the aim of enabling public opinion, decision-makers, decision-makers and various stakeholders to form a picture as close to realism as possible about the nature of the phenomenon of corruption in Egyptian society, its trends and regulatory frameworks And the procedures related to combating them, and the measures taken towards each of them.

The current report includes a monitoring and analysis of the facts of corruption and its combating frameworks during the month of June 2017, and it is the 24th report in the Corruption Status Book series issued by the Partners Foundation for Transparency two years ago (July 2015 - June 2017), as the institution was able to maintain its periodicity throughout those years. Period regularly.

What is worth noting is that Partners for Transparency is planning to develop the Corruption Status Book reports with the aim of introducing improvements to the monthly reports to keep pace with the changes and meet the concerned parties' need for information that helps to adopt effective policies in the fight against corruption, and report No. 25 will be issued committed to the new form and content.

Analysis of legislative and procedural developments during June 2017:

By the end of June 2017, the Egyptian parliament ended its second session without completing a set of legislative proposals related to combating corruption, despite the fact that a number of representatives had already submitted positive perceptions and drafts that could be built upon, in addition to the interested and active people expecting more positive legislative performance in terms of It is related to combating corruption and developing legal systems that help in this. They called on Parliament to enact a package of important laws, such as the law regulating the circulation of information, the law of the Anti-Corruption Coordination Body, the Law on the Protection of Whistleblowers and Witnesses.

Wasting the second session of Parliament without approaching the necessary legislation to combat corruption and promote transparency, integrity and accountability reveals the gap between the state apparatus regarding the nature of interest in the phenomenon of corruption and the seriousness in combating it, and it is the gap whose features are evident from the following: -

1 - The efforts made by the Administrative Control Authority without a “legislative back” appear to be forces that support it, as the commission still relies mainly on the political support it received from the president, while the parliament did not play its role in supporting the commission by reforming legislation and providing an anti-corruption legal environment.

2 - There is a clear gap between the political rhetoric related to combating corruption, which is repeated frequently by the President and some executive leaders, and legislative behavior (whether at the level of submitting government legislation to parliament or the parliament’s initiative to discuss proposals submitted by its representatives), as the elapsed session He did not witness the introduction or discussion of any of the essential anti-corruption laws.

3- The oversight role of Parliament during its second session was characterized by extreme weakness compared to the first session which witnessed the Parliament's success in exploding the issue of corruption in wheat supplies, an issue that led to the resignation of the former Minister of Supply and the submission of a large number of those involved to investigation and trial.

 

And from Positive aspects In the parliamentary performance during the month of June 2017, the approval of the Legislative and Constitutional Affairs Committee on Egypt's accession to the African Union Convention for Preventing and Combating Corruption, which entered into force as of 2006, and Egypt is the 38th country to ratify the convention. Otherwise, some representatives submitted requests for briefing related to some issues. Corruption or proposals to activate the role of some regulatory bodies, and the most important of these requests and suggestions are as follows: -

  1. A request submitted by Representative Sherine Farrag and signed by 52 deputies to assign the Central Auditing Agency to prepare a report that includes examining grants, loans, agreements and foreign projects for the Ministry of Environment and its affiliated agencies.
  2. A briefing request submitted by MP Khaled Abdel Mawly, Secretary of the Transportation Committee, addressed to Dr. Sherif Ismail, Prime Minister and Engineer Tariq Al Mulla, Minister of Petroleum, regarding corruption in the General Petroleum Company, in the case of leasing 40,000 meters to the "Magawish" company for 35 piasters.
  3. A briefing request submitted by MP Saeed Hassassin addressed to Prime Minister Sherif Ismail, Dr. Hisham Al Sharif, Minister of Local Development, and Dr. Mostafa Madbouly, Minister of Housing, on the collapse of real estate in Egypt
  4. A briefing request submitted by Deputy Yusra Al-Assiouty addressed to Dr. Ahmed Emad El-Din, Minister of Health, regarding financial and administrative violations at Mansheyet El-Bakry General Hospital.
  5. A briefing request submitted by MP Atef Makhlif regarding the Minister of Business Sector Dr. Ashraf Al-Sharqawi facilitating the sale of partnership operations on the Ministry's lands at a low price.
  6. A briefing request submitted by MP Ahmed Sharmoukh to the Prime Minister and Minister of Housing regarding the stoppage of the sewage project in many villages of Mallawi Center in Minya Governorate.

In another context separate from the negative legislative performance related to combating corruption, the month of June witnessed the launch of an advertising campaign to raise awareness and motivate to play a positive role in combating corruption under the auspices of the Administrative Control Authority, a campaign that was well received and popularized, and it is important to study its repercussions and effects in a scientific and systematic manner during the period. Next, and working on its development, continuity and diversification of its tools and messages.

The month of June 2017 also witnessed the issuance of some important ministerial statements related to some aspects of combating corruption, especially with regard to the investment climate, business environment, industry and localities. The most prominent statements are as follows: -

  • Dr. Sahar Nasr, Minister of Investment and International Cooperation, said during her meeting with the representative of the United Nations Regional Office on Crime and Drugs for Africa and the Middle East that the government adopts anti-corruption measures within its economic and social program and the state's response to corruption in all its forms in various fields and sectors as it poses a threat not only to development and prosperity efforts. Also for its security and stability
  • The Minister of Local Development stated that a sector was created to combat corruption through the Inspection and Supervisory Follow-up Authority at the Ministry of Local Development to follow up complaints and monitor financial and administrative violations in the governorates, noting that the inspection body has a disciplinary character.
  • Eng. Tarek Kabil, Minister of Trade and Industry, stated during his speech before the activities of the "Integrity Initiative" conference organized by the Egyptian Association of Young Businessmen in cooperation with the United Nations Global Compact, that it is necessary to promote and spread the principles and practices of transparency and integrity, and the concerted efforts of the private and public sectors to face the challenges related to corruption. Pointing out that corruption hinders sustainable development processes, reduces investment opportunities, and reinforces the loss of confidence in the state's public and private institutions.

Monitoring and classifying incidents of corruption during June 2017

First: Distribution of corruption incidents according to sectors:

Monitoring results revealed that the month of June 2017 witnessed 56 incidents of corruption, as the catering, health and local sectors accounted for nearly 54% of the total incidents, with a total of 30 incidents in the three sectors, which is consistent with the general results reported two years ago.

5 ministries, namely, Education, Interior, Endowments, Agriculture and Higher Education, acquired approximately 30% from corruption incidents during the month of June 2017, while the ministries of Irrigation and Water Resources, Electricity, Transport, Trade and Industry, Culture, Civil Aviation, Petroleum, Justice, collectively, Approximately 16% incidents of corruption with a balance ranging from two incidents to one incident per sector.

Second: Distribution of corruption incidents according to the position of the case:

Monitoring data during June 2017 revealed that  The incidents that are subject to investigation came in the first place among corruption incidents during June 2017, where the largest percentage was recorded at 73%, followed by the cases under trial with a rate of 20%, then the incidents that were judged by the rate of 5 %, and finally the incidents that were not investigated in the last place with a rate of 2%

Third: The distribution of corruption incidents according to the governorates:

Geographically, the data indicate that the Cairo governorate alone acquired about 30% of corruption incidents during the month of June 2017 (17 incidents). This may be due to the concentration of administrative headquarters and offices of all sectors and ministries in the capital, while the data indicate that the governorates of Giza, Alexandria, Qalyubia, Menoufia and the Red Sea have taken place together. About 35% incidents of corruption, with a total of 20 incidents, while the remaining percentage (approximately 35%) was distributed to the governorates of Beheira, Dakahlia, Beni Suef, Assiut, Damietta, Qena, Kafr El Sheikh, Sharkia, Sohag and, Ismailia, Port Said, Minya, and Suez with a total of 19 Occurrence.

Incidents of corruption that were recorded during June 2017:

  1.   19. The report of the Central Auditing Agency during the periodic review of the fixed assets of the Egyptian Electricity Transmission Company in Minya “Central Egypt Region” revealed that the company had constructed an administrative building for the company in the industrial zone at a cost of EGP 13 million and that the building had not been used since its construction was completed in May 2013.
